Fabrication Tolerances Disclaimer:
All custom metal parts are subject to standard industry tolerances. While we strive for precision, slight variations in dimensions and tolerances may occur due to material properties and fabrication processes. These deviations will not affect the overall functionality or quality of the final product. Additionally, we are not responsible for errors in customer-supplied designs or specifications. It is the customer’s responsibility to ensure that all designs meet necessary fabrication standards and are free of errors before submission. Any modifications required after production has started may incur additional charges.

Customer-Supplied Designs Disclaimer
By submitting a design for custom fabrication, you warrant that the design is your original creation or that you have obtained all necessary permissions to use the design. We are not responsible for verifying ownership of the design, and you agree to indemnify and hold us harmless from any claims or damages arising from intellectual property disputes related to customer-supplied designs. Any errors, omissions, or inaccuracies in customer-supplied designs are the sole responsibility of the customer. Any modifications required after production has started due to errors in the supplied design may result in additional charges and production delays.

Material Selection Disclaimer
We will fabricate products using materials specified by the customer; however, we are not responsible for the suitability of these materials for the intended application. It is the customer’s responsibility to ensure that the selected materials meet all performance, durability, and safety requirements for their specific use case. Any issues arising from unsuitable material selection are the sole responsibility of the customer. In cases where specified materials are unavailable or unsuitable for the intended application, we reserve the right to substitute materials of equal or greater quality. We will notify the customer of any material substitutions prior to production.

Improper Installation or Use Disclaimer
We are not liable for any damages, failures, or performance issues resulting from improper installation or misuse of our fabricated products. It is the customer’s responsibility to ensure that all products are installed correctly and used according to industry standards and safety guidelines. Any issues arising from improper installation or use will not be covered by warranties or guarantees.

Design Approval and Changes Disclaimer
We reserve the right to review all customer-supplied designs for feasibility. If we determine that a design is not feasible for fabrication due to technical limitations or material constraints, we will notify the customer and suggest modifications. We are not responsible for delays or additional costs incurred due to necessary design modifications.

No Guarantee on Aesthetic Outcomes
While we strive to meet all aesthetic specifications provided by the customer, variations in surface finish, color consistency, and texture may occur due to material properties and fabrication processes. These variations do not affect product performance and are considered acceptable within industry standards.

Lead Time and Production Delays Disclaimer
All lead times provided are estimates and may vary based on material availability, design complexity, and other factors beyond our control. We are not responsible for delays caused by unforeseen circumstances but will make every effort to meet agreed-upon deadlines. Any changes requested after production has begun may result in additional charges and further delays.

Design Approval and Changes Disclaimer
Once a design has been approved by the customer, any subsequent changes may result in additional charges and potential delays in production. We will not be responsible for any costs or delays associated with changes made after design approval. Customers are encouraged to thoroughly review designs before giving final approval to avoid additional charges.

Limitation of Liability for Errors in Final Design
We are not responsible for undetected errors in final design drawings that have been approved by the customer. Any changes requested after approval will incur additional charges and may result in production delays.

Force Majeure Clause
We shall not be held liable for any delay or failure in performance caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, supply chain disruptions, labor strikes, pandemics, or governmental actions. In such events, we will make every effort to notify customers as soon as possible regarding expected delays.

9. **Payment Terms**

All invoices are due within 30 days from the date of issuance unless otherwise agreed upon in writing. If payment is not received by the due date, the invoice will be considered overdue.

Late Fees
In the event of late payment, we reserve the right to charge a late fee of 5% on the overdue balance. The late fee will be applied monthly until the balance is paid in full. The late fee will be clearly outlined on the invoice and will accumulate based on the outstanding amount.

Example: A 5% monthly late fee on a $1,000 overdue invoice will result in an additional $50 charge for each month the payment remains unpaid.

Interest on Overdue Invoices
We may also charge interest on overdue invoices at a rate of 1% per month on any outstanding balance after 30 days following the due date. Interest charges will begin accruing after this period.

Compounding Interest
If applicable, compounding interest will be charged on both the original invoice amount and any previously accrued interest or fees. This means that unpaid interest will also accrue additional interest over time.

Grace Period
A grace period of 30 days may be offered before late fees or interest charges are applied. If payment is made within this grace period, no late fees or interest will be charged.

Additional Collection Costs
If an invoice remains unpaid and we are required to take legal action or employ a collection agency to recover the debt, you agree to reimburse us for any reasonable costs incurred in collecting the overdue amounts, including legal fees and expenses.

Notification of Late Fees
We will notify clients of any late fees or interest charges applied to their account via email or written communication. It is your responsibility to ensure that we have your correct contact information on file for such notifications.

Dispute Resolution for Late Payments
If you believe there is an error with your invoice or dispute any charges, please contact us at contact@csgmb.com within 30 days of receiving the invoice so we can resolve the issue promptly.
